1. The three tests courts apply
Nigeria has no single statutory test. Courts examine the true nature of the relationship:
- Control: do you direct how, when, and where the work is done? Supervised daily work points to employment.
- Integration: is the person part of your business (your email, your shifts, your team) or serving it from outside?
- Personal service: must they do it themselves, or can they send someone else? No substitution points to employment.
A contract titled "consultancy" fails all three tests the moment the person resumes at your office every day under your manager.

3. What misclassification costs
A reclassified worker can claim everything employment would have given them, retroactively: back PAYE with interest and penalties against you, unremitted pension contributions with monthly penalties, missed NSITF assessments, accrued leave, and damages for wrongful termination before the National Industrial Court. Each month the arrangement runs, the bill grows. Document every engagement against the three tests before onboarding, not after a dispute starts.
4. The SME rule of thumb
Use contractors for defined deliverables with an end date, specialist skills you need occasionally, and work where you genuinely do not control method or schedule. Put people on payroll for ongoing, supervised roles at the core of your operations: sales staff on daily targets, shop attendants, drivers on your routes, cooks on your roster. When in doubt, payroll is cheaper than a reclassification.

Do contractors get pension, leave, and minimum wage?
No. Pension, paid leave, minimum wage, and unfair-dismissal protections attach to employment only. If a contractor arrangement is reclassified as employment, all of those entitlements accrue retroactively, which is where the real cost hides.
