1. First warning vs final warning
A first warning records misconduct and demands improvement within a stated period, commonly 30 to 90 days. A final warning follows repeated or serious misconduct and states explicitly that any further breach will lead to dismissal. The standard ladder runs query, first warning, final warning, then dismissal, though gross misconduct such as theft or assault can justify moving straight to dismissal after a single fair process.
2. What every warning letter must contain
- The misconduct, with dates and the rule breached, referencing the prior query and hearing.
- The improvement required, specific and measurable, with a review date.
- The consequence: for a first warning, that repetition leads to a final warning; for a final warning, that repetition leads to dismissal.
- Warning lifespan: how long it stays live on record, commonly 6 to 12 months of clean conduct.

What is the difference between a first warning and a final warning?
A first warning records misconduct and demands improvement within a stated period. A final warning follows repeated or serious misconduct and states clearly that any further breach will lead to dismissal. Courts treat a final warning as the last step before termination must be justified.
How many warnings must I issue before dismissing an employee in Nigeria?
The Labour Act sets no fixed number. Your contract or handbook governs, commonly query, first warning, final warning, then dismissal. For gross misconduct such as theft or assault, dismissal may follow a single fair process without the full ladder.
Should the employee sign the warning letter?
Ask them to sign acknowledging receipt, and note the date. If they refuse, record the refusal with a witness signature. The signature proves delivery, not agreement, and the letter stands either way.
How long does a warning stay on an employee's record?
Set an expiry in your policy, commonly 6 to 12 months of clean conduct, after which the warning lapses for progressive-discipline purposes. State the expiry in the letter itself so expectations are clear.
Can an employee appeal a warning letter?
