What a good offer letter includes
- Section 7 particulars: title, duties, start date, location, pay and how it is calculated, hours, and notice terms, with a pointer to the full written statement due within three months.
- Probation in writing: length, what applies during it, and written confirmation at the end. If it is not written, it does not exist.
- Pay, stated plainly: gross monthly salary plus the statutory deductions line (PAYE under NTA 2025, 8% pension, 2.5% NHF), so nobody is surprised on payday.
- Acceptance block: the candidate signs and dates, and you file it. That signature is what makes the terms stick.
Offer letter questions employers ask
Is an offer letter legally binding in Nigeria?
A signed offer letter creates binding obligations on the terms it states, though it is preliminary to the full employment contract. Always follow it with a complete contract covering all Section 7 particulars within three months of start date.
What must an offer letter include in Nigeria?
Job title and duties, start date, work location, pay and how it is calculated, working hours, probation terms if any, leave entitlement, notice periods, and a pointer to the full written particulars required by Section 7 of the Labour Act.
How long can probation be in Nigeria?
The Labour Act sets no fixed length; probation is whatever the contract states, commonly 1 to 6 months. State the length, the shorter notice that applies during it, and that confirmation will be communicated in writing.
What is the difference between an offer letter and an employment contract?
An offer letter proposes the key terms to win the candidate's acceptance. The employment contract is the complete binding agreement covering every Section 7 particular. Issue the letter first, the contract within three months of starting.
Can I withdraw a job offer after the candidate accepts?
Withdrawing an accepted offer can create liability for losses the candidate suffered relying on it, such as resigning elsewhere. If circumstances change, take advice before withdrawing, and never withdraw for discriminatory reasons.
